These Terms & Conditions (“Terms”) govern your use of the website eventeaseballoondecornj.com (the “Site”) and your engagement with Event Ease Balloon Décor NJ (“we,” “us,” or “our”) for balloon décor services. By using the Site or requesting services, you agree to these Terms. If you do not agree, please do not use the Site.
We operate from Rockaway, NJ, United States. We are affiliated with Event Ease Party Rentals; equipment rentals are subject to separate terms on that site.
1. Services
We provide custom balloon décor services (such as arches, garlands, columns, clusters, and backdrops), including design consultation, delivery, and on-site installation, primarily in Morris County, New Jersey, North Jersey, and surrounding NJ communities, subject to availability and agreement. Descriptions and photos on the Site are illustrative; final designs depend on your event, venue, and written or confirmed agreement.
2. Quotes, booking, and agreements
- Quotes. Information provided through the Site, email, or phone (including informal estimates) is for planning purposes unless we confirm otherwise. A binding agreement requires mutual acceptance of scope, price, date, and any deposit or payment terms we specify.
- Changes. Material changes to date, venue, size, or design may require a revised quote and may affect pricing or availability.
- Payment. Deposits, balances, accepted payment methods, and due dates will be communicated when you book. Failure to pay as agreed may result in cancellation or withholding of services.
- Cancellations and rescheduling. Policies for refunds, credits, or fees on cancellation or reschedule will be stated in your booking communication or contract. If not specified, reasonable industry practices apply based on how close the change is to the event date and whether work or materials have already been committed.
3. Venue, access, and safety
- You are responsible for obtaining any permissions required by your venue (including setup times, ceiling hooks, fire codes, and outdoor weather contingencies).
- You must provide safe, reasonable access for delivery and installation and disclose conditions that could affect safety or the install (stairs, ladders, uneven surfaces, pets, etc.).
- Balloons and installations can be affected by heat, cold, wind, sharp objects, and ceiling materials. We are not liable for damage to property when caused by venue conditions, misuse, or factors outside our reasonable control after handoff, except where prohibited by law.
4. Intellectual property
Content on the Site (text, graphics, logos, layout, and original photography where applicable) is owned by us or our licensors and is protected by copyright and other laws. You may not copy, scrape, or reuse Site content for commercial purposes without our prior written permission. Gallery images represent our work; third-party trademarks or themes shown in event photos remain property of their respective owners.
5. Acceptable use of the Site
You agree not to misuse the Site or contact forms, including by submitting false information, spam, malware, or unlawful content, or attempting to disrupt or gain unauthorized access to our systems or third-party services linked from the Site.
6. Disclaimer of warranties
The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
7. Limitation of liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Site or services (except where law requires otherwise, such as certain personal injury claims caused by gross negligence or willful misconduct, if applicable) shall not exceed the greater of (a) the amount you paid us for the specific service giving rise to the claim in the three (3) months before the claim, or (b) one hundred U.S. dollars (USD $100) if no such payment applies.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Event Ease Balloon Décor NJ and its owners, employees, and affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your event or venue arrangements, except to the extent caused by our gross negligence or willful misconduct.
9. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. You agree that courts located in Morris County, New Jersey (or another competent court in New Jersey if required) shall have exclusive jurisdiction over disputes arising from these Terms or the Site, subject to any mandatory rights you may have under the laws of your place of residence.
10. Changes to these Terms
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Site after changes constitutes acceptance of the updated Terms, except where applicable law requires additional notice or consent.
11. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
